Anaheim mayor: Order to delete files, emails was a 'mistake'

Tom taitThe mayor of Anaheim said it was a ?mistake? for planning officials to order employees?to purge files and emails from their computers that might be unflattering to city leaders and local developers.

The warnings were sent to department staff last week, shortly after the online publication Voice of OC filed a Public Records Act request for communications between council members and the planning department.

Employees were warned that if they did not comply with the order, they could be punished.

The requests prompted union leaders in the resort city to complain that employees were being asked to break the law or participate in a coverup.

The Anaheim city attorney's office, which investigated whether the request was illegal, said Thursday that the emails did not violate state law.

But Jennifer Muir, spokeswoman for the Orange County Employees Assn., said the emails "instruct employees to destroy certain public records and discusses the likelihood that certain public records could be embarrassing to public officials."

Anaheim Mayor Tom Tait called the emails "confusing and misleading."

"Unfortunately, these emails within the Planning Department and the manner in which they were articulated were a mistake," the mayor said. "We are taking corrective action to assure this does not happen again."

In an email dated Dec. 27, Sandra Sagert, who heads the city's code enforcement program, wrote that "a not so nice comment about a popular property owner" appeared in an email that was turned over in a public records request.

"As you can imagine," the email read, "the city manager was not happy. There will be disciplinary action for anyone violating this administrative regulation."?

The next day, Hannah Jones, an administrative analyst in the planning department, sent employees an email noting the city has been getting public records requests almost daily and that when "old or unnecessary documents turn up," they can "very easy (sic) portray the actions of city staff, applicants, contractors and decision makers out of context and damage our credibility."

Jones warned that supervisors would be periodically checking up on employees and those who failed to delete old messages and files would face disciplinary action.

Terry Francke, general counsel for Californians Aware, an open government group, said the emails appeared to prod employees to break the law. He said the state Government Code requires cities to retain records for at least two years and that some must be retained indefinitely.

The Jones memo was first revealed by Voice of OC, a small nonprofit news website that was launched 20 months ago.?

Orange County Assistant Dist. Atty. Michael Lubinski, head of the special prosecutions unit, said the employees union forwarded him Jones' email. "Nothing popped out as being clearly criminal by that memo," he said.

"But that doesn't mean there wasn't intent to destroy documents that shouldn't be destroyed."

Video: Race gets closer after Iowa caucuses

>> and chief white house correspondent chuck todd and from our washington bureau, david gregory , moderator of "meet the press." chuck, we'll start with you. if you're mitt romney -- we just looked it up -- we got six fewer votes this time than four years ago. locked at 25%, four years apart, millions of dollars in expenditures apart. what is the lesson? what's the takeaway from iowa last night?

>> well, they do look on the bright side and they see it this way. number one, a win is a win. they won in a place that they lost last time. always important when you're running a second time. number two, they are kind of happy their chief conservative rival is not rick perry , is not newt gingrich , but is rick santorum for the very reason andrea brought up in her piece. he lacks resources. he may not be able to put together a national campaign. while it's still clear mitt romney has a base problem they think over time that they can overcome this and eventually woo conservatives to them, possibly by the south carolina primary , but even if they lose there, by the florida primary at the end of the month, brian.

>> david gregory , a question to you about santorum . the risk, of course, in iowa is what happens in iowa can stay in iowa . after all, huckabee won it there last time. how does santorum convert and what's he up against?

>> he's got a big hill to climb here. good news/bad news. he's got ron paul , rick perry still and newt gingrich attacking frontrunner mitt romney . he'd like to be alone. the only social conservative needs to get the energy behind him. as andrea noted as well, he's going to make a play on electability. he had an effective message on the economy as well. it was about restoring the manufacturing base in this country as working class voter appeal here. it's a good contrast the santorum folks think they will have against mitt romney .

>> i used the expression "welcome to the nfl." it gets start starting right about now. this calendar becomes gruelling.

>> it does. you have to move quickly. we are already six days from the new hampshire primary. for rick santorum to prove he can go the distance, he's at least got to finish second here and probably in a healthy number with 20%, 25%. now by the way if you're the conservative candidate you have to win south carolina . that's only 11 days away . ten days is florida. if mitt romney wins just two of any of the next three he's going to be the nominee. it may take a while before he formally gets a delegate but he will be the de facto nominee.

>> chuck todd and david gregory . thank you very much. the

?

MENOS NEUMON?AS

?

Bishop Raymond Lahey was arrested at the Ottawa airport in 2009 after customs authorities found almost 600 pornographic photos of young teen boys on his laptop and a handheld device. Some involved adolescent boys engaged in sex acts while wearing a crucifix and rosary beads.

Lahey pleaded guilty last May to one count of importing child pornography

Ontario Court Justice Kent Kirkland on Wednesday gave Lahey double credit for the time he served. Double credit is not unusual.

At a sentencing hearing last month, Lahey offered an apology.

HONOLULU (AP) ? President Barack Obama will waste little time getting back in front of voters following a 10-day Hawaiian vacation spent largely out of the spotlight.

Air Force One landed just before daybreak in Washington on Tuesday morning after an overnight flight from the island of Oahu. The president is returning from vacation the same day Republican presidential candidates square off in the Iowa caucuses, the first nominating contest of the 2012 campaign.

Obama plans to make his presence in the campaign known quickly.

The president will host a live web chat with supporters in Iowa on Tuesday night as the caucuses are unfolding. The following day, Obama will travel to Cleveland for an event focused on the economy.

Obama aides said the president will seek to draw a contrast with his GOP challengers during Wednesday's trip to Ohio, a state sure to figure prominently in the presidential campaign.

Obama returns to Washington facing further debate on extending payroll tax cuts, the same issue that consumed Washington during the final days of December.

Congress broke through a stalemate just days before Christmas, agreeing to extend the cuts for two months. Lawmakers will get back to work later this month to negotiate a full-year extension of the cuts, which Obama supports.

White House officials say the tax cut extension is the last "must-do" legislative item on Obama's agenda this year. His strategy for his fourth year in office will focus largely on taking executive actions that do not need approval from lawmakers as he seeks to break away from a deeply unpopular Congress.

The payroll tax cut debate almost prevented Obama from taking his annual Christmas trip to Hawaii. He delayed the trip nearly a week, finally departing on Dec. 23, just hours after Congress finalized the two-month extension.

The president, wife Michelle and daughters Malia and Sasha stayed largely out of the public eye during their trip to Oahu, the island where Obama was born and mostly raised.

The Obamas stayed in a multimillion-dollar oceanfront rental on Kailua Beach, near Honolulu, and surrounded themselves with a close-knit group of family and friends. That included Obama's sister, Maya Soetoro-Ng, who lives on Oahu, and several of the president's childhood friends.

Obama's outing consisted largely of trips to the gym and golf course at Marine Corps Base Hawaii near his vacation rental. The first family also made a few outings around the island, including a snorkeling trip to popular Hanauma Bay and a stop for shave ice, a Hawaiian snow cone.

The president also took his family to the East-West Center, a research and exhibition center that is displaying the anthropological work of his late mother.

Aides say Obama spent a bit of time on vacation brainstorming ideas for his Jan. 24 State of the Union address, where he will lay out an agenda that also will serve as the basis for his campaign message. He also was briefed by a small cadre of traveling advisers on some of the international issues looming in 2012, including renewed threats from Iran and a request from Yemen's outgoing, autocratic president to come to the U.S. for medical treatment.
